1. Acceptance of Terms
These Terms of Service ("Terms") are a binding agreement between you and Blyp Oy ("Blyp," "we," "us," "our") governing your use of the Blyp mobile application and related services (the "Service").
1.1 Agreement to Terms
By using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.
1.2 Changes to Terms
We may update these Terms. When we make material changes, we'll give you at least 14 days' advance notice through in-app notification before the changes take effect, and update the "Last Updated" date above. If you keep using the Service after changes take effect, you're accepting the updated Terms. If you disagree, stop using the Service and delete your account before the effective date.
For non-material changes (clarifications, formatting, typo corrections), we'll update the "Last Updated" date and the changes take effect immediately.
1.3 Additional Terms
Some features may have additional guidelines or rules posted alongside them. Those additional terms are part of these Terms.
2. Eligibility
2.1 Age Requirement
You must be at least 16 years old to create an account. By using the Service, you confirm that:
- You're at least 16 years old
- You have the legal capacity to agree to these Terms
- You'll follow these Terms and all applicable laws
2.2 Age Verification
We collect your date of birth during account setup and verify that you meet the minimum age requirement. If you're under 16, your account will be deleted. Providing a false date of birth to bypass this requirement will result in immediate account termination.
2.3 Parental Consent
If you're between 16 and 18, you represent that a parent or legal guardian has reviewed these Terms and agrees to them on your behalf.
2.4 Account Limitations
One account per person. Creating multiple accounts or using a new account to evade a suspension or ban is prohibited.
3. Account Registration and Security
3.1 Account Creation
Registration is a two-step process:
Step 1: Registration. You provide a valid email address and a secure password, then accept these Terms and our Privacy Policy.
Step 2: Account Setup. After verifying your email, you provide your name, username, date of birth, gender, and optionally a profile photo.
Alternatively, you can register using Google Sign-In or Apple Authentication (single sign-on). SSO users still need to accept these Terms and our Privacy Policy and complete the account setup step. If you register via SSO, your account is linked to your Google or Apple identity; you may not have a Blyp-specific password unless you set one later.
3.2 Invite and Referral System
Access to the Service may require an invite code. We operate an invite request system where prospective users can request access, and existing users can share referral codes. Referral codes don't guarantee any reward or benefit unless explicitly stated. We may change or discontinue the invite system at any time.
3.3 Email Verification
You must verify your email address before you can fully use the Service. We'll send a verification email during registration. Unverified accounts have limited functionality.
3.4 Accuracy of Information
You agree to:
- Provide accurate and complete information during registration and setup
- Keep your account information up to date
- Tell us immediately if someone gains unauthorized access to your account
Providing false information may result in account termination.
3.5 Account Security
You're responsible for:
- Keeping your password (or SSO credentials) confidential
- Everything that happens under your account
- Telling us about any security breach or unauthorized access
We aren't liable for losses resulting from compromised account credentials.
3.6 Password Requirements
If you use email/password authentication, your password must be at least 8 characters long and include a mix of uppercase letters, numbers, and special characters. Use a password you don't use elsewhere.
3.7 Account Transfer
You can't transfer, sell, or give your account to anyone else.
4. User Content
4.1 What Counts as User Content
"User Content" is anything you submit, upload, post, or share through the Service, including text, images, travel-related content, messages, profile information, and any other material.
4.2 Ownership
You own your User Content. We don't claim ownership of anything you post.
4.3 License Grant to Blyp
By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, and sublicensable license to:
- Use, reproduce, distribute, and display your User Content in connection with the Service
- Modify and adapt your User Content for formatting or display purposes
- Store your User Content on our servers
- Make your User Content available to other users based on your privacy settings
This license ends when you delete your User Content or account, except for:
- Content that other users shared or reposted before deletion
- Content retained for legal or safety reasons
We will not use your User Content to train artificial intelligence or machine learning models, whether our own or those of third parties, without your separate explicit consent.
4.4 Public vs. Private Content
- Public Content: Visible to all users. Appears in search results, recommendations, and feeds.
- Private Content: Visible only to you or to specific recipients (e.g., direct messages).
Some content types have a public/private toggle. You control this setting.
4.5 Your Responsibility
You're solely responsible for your User Content. You must have the right to post it, and it must not violate these Terms or any laws. Don't upload content you don't own or don't have permission to share.
We don't endorse, verify, or guarantee the accuracy of any User Content.
4.6 Content Removal
We can remove any User Content that violates these Terms, at our discretion, with or without notice. We aren't liable for removing or failing to remove content.
5. Intellectual Property Rights
5.1 Our Intellectual Property
The Service itself (its design, code, features, branding, and "look and feel") belongs to Blyp or our licensors. The Service includes open-source software components, each governed by its own license. All other rights are reserved.
5.2 Trademarks
"Blyp," the Blyp logo, and related names and logos are our trademarks. Don't use them without our written permission.
5.3 Your License to Use the Service
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for personal, non-commercial purposes.
You can't:
- Resell or commercially exploit the Service
- Copy, modify, or create derivative works from the Service
- Scrape, data-mine, or use bots to access the Service
- Reverse engineer or decompile the Service
5.4 Feedback
If you send us feedback or suggestions, you grant us a perpetual, worldwide, royalty-free license to use, implement, and incorporate that feedback into the Service, without obligation to compensate you. This license is limited to improving and operating the Service. Your moral rights in any feedback are acknowledged and respected. This applies to feedback submitted through any channel, including the in-app feedback form.
6. Copyright and DMCA
6.1 Copyright Policy
We respect copyright. If you believe your copyrighted work has been infringed on the Service, you can also report it through the in-app reporting system under the "Copyright" category.
6.2 DMCA Takedown
For formal DMCA notices, contact our Copyright Agent with the information required under 17 U.S.C. 512(c):
- Your signature (physical or electronic)
- Identification of the copyrighted work
- Identification and location of the infringing material
- Your contact information
- A good-faith statement that the use isn't authorized
- A statement under penalty of perjury that you're authorized to act for the copyright owner
Copyright Agent: [email protected] (subject: "DMCA Takedown Notice")
See our Copyright Policy for the full process, including counter-notifications.
6.3 Repeat Infringers
We'll terminate accounts of repeat copyright infringers.
7. The Service
7.1 What Blyp Does
Blyp is a social travel platform. The Service provides:
- Travel planning and discovery: tools for creating, browsing, and sharing travel content
- Social features: connecting with other users through groups, messaging, and a shared feed
- Maps and location services: interactive maps and location-based discovery
- Account management: profile customization, privacy controls, and data portability
We may add, modify, or remove features at any time without updating these Terms.
7.2 Service Availability
We don't guarantee the Service will be available at all times, error-free, or compatible with every device. Outages happen. Bugs happen.
7.3 Service Changes
We can modify, suspend, or discontinue any part of the Service at any time. We aren't liable for doing so.
7.4 Beta Features
We may offer beta or experimental features. These are provided "AS IS," may contain bugs, and can be discontinued without notice.
7.5 Free Service with Advertising
The Service is currently free and supported by advertising from third-party ad networks. You can manage your advertising consent preferences in your privacy settings. We may change our pricing model in the future and will notify you before doing so.
8. Messaging
8.1 Messaging Features
The Service includes direct messaging between friends and group chat within groups. Messages are stored on our servers and transmitted using encrypted connections (TLS/HTTPS). Messages are not end-to-end encrypted.
9. Prohibited Activities
Don't do any of the following:
- Break any applicable laws
- Harass, bully, threaten, intimidate, or stalk other users
- Post hate speech or content that discriminates against any group
- Impersonate someone else or create fake accounts
- Run phishing schemes, scams, or fraud
- Send spam or unsolicited commercial messages
- Try to hack into the Service, other accounts, or connected systems
- Use bots, scrapers, or automated tools to access the Service
- Interfere with or disrupt the Service
- Circumvent security measures, authentication, or bot-detection systems (including Turnstile CAPTCHA)
- Infringe on anyone's intellectual property
- Manipulate metrics, create accounts to evade bans, or sell accounts
- Post sexually explicit, pornographic, or gratuitously violent content
- Post content promoting self-harm, suicide, or eating disorders
- Share someone else's private information without their consent
- Abuse the reporting, blocking, or location features (e.g., filing false reports, blocking someone to manipulate visibility)
- Post content that exploits or endangers minors
We may rate-limit certain actions (like reports, blocks, and other user-triggered operations) to prevent abuse. If you hit a rate limit, wait and try again later.
Violations can result in content removal, account suspension, account termination, or referral to law enforcement.
10. Content Moderation, Reporting, and Blocking
10.1 Moderation
We can review, moderate, and remove User Content at our discretion. We aren't obligated to monitor all content, and we can't guarantee every violation will be caught.
10.2 Reporting
You can report content or users through the in-app "Report" button. Available report categories:
- Spam
- Harassment or bullying
- Inappropriate content
- False information / misinformation
- Privacy violation
- Intellectual property / copyright infringement
- Scam or fraud
- Hate speech
- Violence
- Sexual content
- Impersonation
- Other
You can also contact support at [email protected]. The system prevents duplicate reports on the same content.
10.3 What Happens After a Report
We'll review the report and decide whether the content violates these Terms. Depending on severity and frequency, we may:
- Remove the content
- Issue a warning
- Temporarily suspend the account
- Permanently terminate the account
- Restrict access to certain features
- Report illegal activity to law enforcement
10.4 Blocking Users
You can block any user. When you block someone:
- They can't see your content
- They can't send you messages or notifications
- The block is reversible. You can unblock them from your blocked users list in account settings
Blocking is separate from reporting. You can do both, or either.
10.5 Appeals
If you think your content was removed by mistake, contact [email protected] with an explanation. We'll review it, but moderation decisions are at our discretion.
10.6 No Liability for User Content
We aren't responsible for User Content posted by others: its accuracy, legality, or any harm it causes.
11. Privacy
11.1 Privacy Policy
Your use of the Service is governed by our Privacy Policy, which covers what data we collect, how we use it, and your rights under GDPR and other privacy laws.
11.2 Data Protection
We comply with the General Data Protection Regulation (GDPR) and applicable privacy laws. Through the privacy dashboard in the app, you can manage your consent preferences for analytics, advertising, and crash reporting individually.
11.3 Your Responsibilities
Respect other users' privacy. Don't share their private information, don't intercept their communications, and don't misuse data you access through the Service.
12. Third-Party Services
12.1 Third-Party Infrastructure
The Service relies on third-party services for core functionality, including (but not limited to) database hosting, authentication, mapping and geocoding, advertising, analytics, error monitoring, bot protection, and push notifications. For details on data shared with each category of provider, see our Privacy Policy.
12.2 Third-Party Terms
Your use of third-party services is subject to their own terms and privacy policies. We aren't responsible for how third parties handle your data beyond what we describe in our Privacy Policy.
12.3 Third-Party Links
The Service may link to external websites or services. We don't control those sites and aren't responsible for their content, privacy practices, or terms.
13. Disclaimers
13.1 AS-IS and AS-AVAILABLE
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
13.2 Travel and Map Information
User-generated travel information may be inaccurate, outdated, or unsuitable for your situation. Don't rely on the Service as your sole source of travel information. Always verify independently before making travel decisions.
Map data, routes, coordinates, and location information are provided for general reference only and may contain errors, omissions, or outdated information. Map data is sourced from third-party providers and user contributions. We don't independently verify the accuracy of map data. Don't use the Service for navigation in hazardous conditions, emergency situations, or any context where inaccurate location data could result in harm.
13.3 No Guarantee of Availability
We don't guarantee the Service will be uninterrupted, secure, or error-free. We don't guarantee your data will always be accessible.
14. Limitation of Liability
14.1 Exclusion of Damages
To the fullest extent permitted by applicable law, Blyp, its officers, directors, employees, and affiliates won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from:
- Your use or inability to use the Service
- Conduct or content of other users
- Unauthorized access to your data
- Travel decisions based on information from the Service
- Any other matter related to the Service
14.2 Cap on Liability
Our total liability for all claims related to the Service won't exceed the greater of EUR 100 or the amount you paid us in the 12 months before the event giving rise to the claim.
14.3 Statutory Rights Preserved
Nothing in these Terms limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that can't be excluded under applicable law (including mandatory EU consumer protection rights)
14.4 Third-Party Actions
We aren't liable for the actions of other users, the accuracy of User Content, or third-party services.
15. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Blyp, its officers, directors, employees, and affiliates from claims, damages, losses, and expenses (including legal fees) arising from:
- Your use or misuse of the Service
- Your User Content (including IP infringement claims)
- Your violation of these Terms
- Your violation of any law or anyone's rights
We can take over the defense of any indemnified claim. You can't settle any claim without our written consent.
EU Consumer Carve-Out: If you're a consumer in the European Union, this indemnification clause doesn't apply to the extent it would be considered unfair under Directive 93/13/EEC on unfair terms in consumer contracts. Nothing in this section requires you to indemnify us for losses caused by our own negligence, breach of contract, or violation of applicable law.
16. Modifications to Service
We can modify, suspend, or discontinue any part of the Service at any time, including changing features, imposing storage limits, or updating the app for security or legal reasons. We aren't liable for any modifications, and we'll make reasonable efforts to notify you of material changes, but we aren't required to give advance notice.
17. Termination
17.1 Termination by You
You can delete your account at any time through Settings > Delete Account. You'll need to verify your identity with your password and type a confirmation phrase.
What happens when you request account deletion:
- Your account is immediately deactivated. Your profile, content, and data become invisible to all other users
- You have 14 days to cancel the deletion by logging back in
- After 14 days, your personal data is permanently and irreversibly deleted
- Your profile photos and images are deleted from storage
- Your profile, messages (both direct and group), and private content are removed
- Public itineraries you created may be anonymized (your name removed) rather than deleted, to preserve their value to the community
- A minimal audit log is retained for a limited period for legal compliance
- Litigation hold: If your account or content is subject to a pending legal proceeding, regulatory investigation, or lawful preservation request, we may suspend the deletion timeline until the hold is lifted. We'll notify you when a hold is placed unless legally prohibited from doing so.
- Moderation persistence: If your account had active moderation actions (suspensions, warnings, content removals, or bans) at the time of deletion, those actions remain in effect if you cancel the deletion during the grace period. Deleting your account does not erase your moderation history.
17.2 Termination by Us
We can suspend or terminate your account for cause, including:
- Violation of these Terms
- Illegal activity or harmful conduct
- Being under 16 years old
- Repeated violations after warnings
- Harassment, hacking, impersonation, or fraud
When we terminate or suspend your account, we'll provide you with:
- A statement of reasons explaining which specific Terms were violated or which conduct led to the action
- At least 30 days' advance notice before termination takes effect, except where immediate action is necessary to prevent harm, comply with legal obligations, or address serious violations (e.g., illegal content, imminent safety threats)
- An opportunity to appeal the decision by contacting [email protected] within 30 days of the notice. We'll review your appeal and respond within a reasonable timeframe
17.3 Effect of Termination
When your account is terminated (by you or by us):
- Your right to use the Service ends immediately
- We may delete or anonymize your content
- You're still liable for obligations incurred before termination
- Sections that logically survive termination (disclaimers, liability limits, indemnification, governing law) continue to apply
18. Dispute Resolution
18.1 Informal Resolution First
Before starting any formal dispute process, contact us at [email protected] to try to resolve the issue informally.
18.2 Mediation
If informal resolution doesn't work, we'll attempt mediation through a mutually agreed-upon mediator before proceeding to litigation.
18.3 Jurisdiction
For EU users: Disputes will be resolved under the laws and courts of Finland, subject to your mandatory consumer protection rights under EU law. This means you can always bring claims in the courts of your country of residence if EU consumer law gives you that right.
For users outside the EU: Disputes are subject to the jurisdiction of the courts of Finland.
18.4 European Commission Online Dispute Resolution
If you're in the EU, you can use the European Commission's online dispute resolution platform at https://ec.europa.eu/consumers/odr/. We're willing to participate in dispute resolution proceedings before a consumer arbitration board.
19. Governing Law
19.1 Applicable Law
These Terms are governed by the laws of Finland.
19.2 EU Consumer Protection
If you're a consumer in the EU, you benefit from the mandatory consumer protection laws of your country of residence. Nothing in these Terms overrides those statutory rights. Where these Terms conflict with mandatory EU consumer protections, the consumer protections prevail.
19.3 International Use
The Service is operated from the European Union. If you access it from outside the EU, you're responsible for complying with your local laws.
20. General Provisions
20.1 Entire Agreement
These Terms, our Privacy Policy, and any additional terms we reference make up the entire agreement between you and Blyp.
20.2 Severability
If any part of these Terms is found invalid or unenforceable, that part will be enforced to the maximum extent possible, and the rest stays in effect.
20.3 Waiver
If we don't enforce a right under these Terms, that doesn't mean we've waived it.
20.4 Assignment
You can't assign or transfer your account or these Terms to anyone. We can assign our rights in connection with a merger, acquisition, or sale of assets.
20.5 Force Majeure
We aren't liable for failures or delays caused by things outside our reasonable control: natural disasters, war, government actions, pandemics, infrastructure failures, and similar events.
20.6 Notices
To you: We'll send notices via email, in-app notifications, or posting on the Service.
To us: Contact us at [email protected].
20.7 Language
These Terms are written in English. The app is available in multiple languages, but the English version of these Terms controls if there's any conflict with a translation.
20.8 App Store Terms
If you downloaded the app from Apple's App Store or Google Play, you must also follow their terms. If these Terms conflict with app store terms, these Terms prevail to the extent the app store allows.
20.9 No Third-Party Beneficiaries
These Terms don't create rights for anyone other than you and Blyp, except as expressly stated.
20.10 Export Control
You agree to comply with applicable export control and sanctions laws. Don't use the Service if you're in a sanctioned country.
21. Contact Information
For support, legal, copyright, or data protection inquiries, contact us at [email protected].
